Welcome to the WheatandDairyFree.Com website. The use of this Website (wheatanddairyfree.com) is subject to these Terms of Use. By using this website you are deemed to have agreed to the terms set out below. If you do not want to be subject to these terms please do not use our website. Any conditions stated on this website do not affect your statutory rights as a consumer. We reserve the right to refuse access to the website, remove or edit content or cancel orders at our discretion. If we cancel an order it will be at no cost to you.

We may periodically change these terms and you should review them often. These terms were last updated on 14th January 2008.

Orders can only be accepted from customers who are 18 years or older. If you are under 18 years of age you are welcome to browse our website but we regret that we are unable to accept any order from you.

Our Contract

A contract for sale of goods between you and WheatandDairyFree.Com shall be deemed to have been made in the United Kingdom and shall be governed by the laws of England and Wales. Any disputes arising from this website shall be resolved by the English Courts. If any provision of these Terms is found to be illegal, void or unenforceable by any court or administrative body of competent jurisdiction, such determination or decision shall not affect the other provisions of these Terms which shall remain in full force and effect but only insofar as these Terms are capable of continuing in existence without the excluded term or terms.

Prices

All prices quoted on this website, where appropriate, are inclusive of UK sales tax (VAT) at the current rate (17.5%). If we have mispriced an item we will notify you of the actual price and allow you to consider whether you wish to continue with our purchase at the correct price. We will not be liable to supply the item at the mistakenly quoted price. We reserve the right to change the prices at any time prior to accepting any order from you without prior notice.

Prices quoted on the Website do not include delivery charges. Details of our delivery charges can be found on the delivery page.

Payment

Payment for goods ordered can be made using switch, mastercard or visa cards. Payment will be debited from your account upon completion of your order. Completing the payment information and submitting the order implies authority to debit the relevant card. Goods will not be sent until funds have been cleared.

WheatandDairyFree.Com uses PayPal to process your financial information and operates a secure site but PURCHASES FROM THIS WEBSITE ARE AT YOUR OWN RISK.

Privacy

When you purchase goods from this website you will be asked to give us personal information including your name, address, telephone, fax and email details and financial information. We may also gather automatic information from you by the use of cookies. A number of companies offer systems so that you can visit websites anonymously if you would prefer this.

The information you give us is very important to us in order to provide you with a better service. We will not sell it or give it to anyone else.

Availability

All goods are subject to availability and WheatandDairyFree.Com reserves the right to discontinue supplies of goods at any time, without notice. We shall not be liable for any claim relating to such discontinuance.

We will make every effort to have adequate stock of goods available, but occasionally we may be unable to supply an item. If we are unable to supply an item we will advise you of this by e-mail. You will then have the choice of cancelling your order for the item and receiving a refund or asking us to hold your order until we can include the unavailable item.

Returns and Refunds

In relation to food and drink (perishable items) you will not have the right to cancel your order once the order has been sent.

In relation to non-perishable goods you have 7 working days in which to cancel your order by notifying WheatandDairyFree.Com by email to theteam@wheatanddairyfree.com. If you cancel your contract after the goods have been sent, you must also return all the cancelled goods to WheatandDairyFree.Com. We shall only accept such goods if they are returned to us in the same, saleable condition in which they were delivered to you.

On return of the goods we will refund your credit or debit card with the total value of the goods within thirty (30) days of the date of cancellation. The cost of returning the goods to us shall be at your expense.

When returning goods please pack them carefully and include all delivery paperwork and a note to say why you have returned the goods, and send it back to:

We will not accept any responsibility for loss or damage to goods returned in this way until they are received at our address, and we strongly recommend that returns are sent by Recorded Delivery or some other means of tracked delivery system.

If however any items including food or drink is either damaged or defective or is not the item that you ordered you will be entitled to a full refund. You should notify WheatandDairyFree.Com by email to theteam@wheatanddairyfree.com and return the goods on which you are seeking a refund to us within 21 working days. The cost of returning any goods which are damaged, defective, or not the item you ordered, shall be refunded to you by WheatandDairyFree.Com. Please send us an email to theteam@wheatanddairyfree.com confirming the cost of returning the goods. WheatandDairyFree.Com will replace any defective or incorrectly dispatched goods free of charge or will offer you a full refund but shall have no further liability to you. This does not affect your statutory rights as a consumer.
